1. Nature of Services
Apensia provides political consulting, digital PR, and election management services as an Independent Contractor. Our role is advisory and execution-based. We do not act as employees, legal agents, or official spokespersons for the Client unless specifically authorized in a signed annexure.
2. No Guarantee of Outcome
While Apensia utilizes data-driven methodologies and proven PR tactics, we do not guarantee specific election results, vote shares, or victory. Political outcomes are influenced by external variables (opposition moves, wave factors, voter turnout) beyond our control.
3. Client Responsibilities
The Client agrees to provide accurate information and timely approvals. Apensia is not liable for delays or campaign errors resulting from the Client providing false data or withholding critical information regarding their political standing.
4. Intellectual Property
All campaign materials (videos, graphics, slogans) created specifically for the Client become the Client's property upon full payment. However, Apensia retains ownership of its proprietary "Strategy Frameworks," internal software tools, and data-mining methodologies used during the campaign.
5. Payment & Termination
Retainer fees are non-refundable as they secure constituency exclusivity. Either party may terminate the agreement with a 15-day written notice, subject to the settlement of all outstanding dues for work completed up to the termination date.
