Who we are
Apensia Media (“Apensia”, “we”) is based at SCO 107-109, Sector 34A, Chandigarh 160022, India. “You” means the person or company placing an order.
Your account
Give accurate details when you register, including a mobile number and e-mail address we can reach you on, and keep your password private. You are responsible for activity on your account. Tell us at once if you think someone else has used it. We may suspend accounts used for fraud or abuse.
Packages and quotes
Fixed-price packages can be ordered and paid for online. E-commerce, web application and SEO retainer packages are quoted inside the published range after we understand your scope; a quote binds both sides when you accept it in your dashboard and pay the first invoice. Package descriptions summarise typical scope. The written scope we confirm for your order is the final record of what is included.
Prices, currency and tax
Prices are shown in Indian rupees (INR) and US dollars (USD) and exclude tax. Where we are registered for GST, clients in India are charged GST at the rate shown on the invoice: CGST and UTGST (or SGST) where your state is the same as ours, otherwise IGST. Invoices for clients outside India are issued in USD without Indian GST where the export-of-services conditions are met. Taxes, duties or bank charges in your own country are your responsibility. We are not tax advisers. USD amounts are fixed in dollars once an invoice is issued and are not adjusted for exchange-rate movement.
Payment
You can pay by UPI or bank transfer (INR) or by international bank wire (USD) and then send us the transaction reference in your dashboard. A payment counts as received only when it reaches our bank account and we have matched it to your invoice. Work starts when the advance (or full payment, for packages billed in full) is confirmed. One-off audits, YouTube plans and all monthly services are billed 100% in advance. If a wire arrives short because of intermediary bank charges, we will ask for the difference before handover.
Monthly services
Monthly packages (SEO retainers, Instagram suites, YouTube Growth Sprint and Full YPP Partner, digital marketing) are invoiced one month at a time. We raise each next invoice from your order page; the service for a month continues once that month is paid. You can stop by telling us in writing before the next invoice is raised. Advertising spend paid to Google, Meta or any other platform is separate from our management fee and is paid by you directly to the platform.
Scope, documents and changes
You can upload a scope of work, software requirements specification (SRS), website requirements specification (WRS) and other files to your order. We review them and confirm the scope in writing. Changes after confirmation are change requests and may change the price or timeline; we tell you before doing extra work. Delays caused by late content, access, feedback or approvals move timelines accordingly.
Revisions and acceptance
A deliverable is treated as accepted when you approve it in writing or use it live. Requests that add pages, features or integrations are changes to scope, not revisions.
Your responsibilities
You are responsible for the content, images, music, footage, fonts and other material you give us, and you confirm that it is original or properly licensed. We are not responsible for copyright claims over client-supplied material. You will not ask us to build or promote anything unlawful, deceptive, infringing or harmful. You are responsible for the lawful use of the finished work, including privacy notices, consent and any licences your business needs.
Account access and platform rules
Some services (YouTube, Instagram, Google Business Profile, ad accounts, hosting) need access to your accounts. Share access only in the way each platform allows, keep ownership of your accounts, and change passwords after the work ends. We follow each platform’s policies, use organic methods only and do not buy views, followers, links or engagement. You agree to keep to those policies too. Platforms can change their rules, remove content or refuse monetisation at their own discretion.
No guarantee of rankings, monetisation or revenue
We work to improve search visibility, channel growth and monetisation eligibility, but we do not and cannot guarantee any ranking, traffic, subscriber or watch-hour count, Partner Program approval, ad revenue, sponsorship, enquiries or sales. Google, YouTube, Meta and other platforms make those decisions, not us. Timelines we quote are estimates.
Ownership of the work
Once all invoices for a project are paid in full, you own the website design and the custom code written for you. Third-party components, frameworks and fonts stay under their own licences. Until payment is complete we keep ownership of the work and may withhold handover. We may show non-confidential screenshots of finished work in our portfolio unless you ask us not to.
Domains and hosting
Domain registration and hosting are set up in your name and billed by the provider at cost unless we agree otherwise in writing. We are not responsible for outages or changes made by third-party providers.
Support after launch
Support after launch is limited to the period stated in your package or quote. Ongoing maintenance is a separate paid service agreed in writing.
Confidentiality
We treat the documents, access and information you share as confidential and use them only to deliver your project, except for information that is already public or that we must disclose by law.
Limitation of liability
To the extent the law allows, our total liability for any claim connected with an order is limited to the amount you paid us for that order in the three months before the claim, and we are not liable for indirect or consequential loss such as lost profit or lost data. Nothing in these terms limits liability that cannot lawfully be limited.
Cancellation and termination
Either of us may end a project in writing. Refunds on cancellation are covered by the refund policy. We may stop work if an invoice is overdue or if you breach these terms.
Governing law and disputes
These terms are governed by the laws of India. We will try to resolve any dispute by talking first. If that fails, the courts at Chandigarh have jurisdiction, subject to any rights you have under mandatory law where you live.
Changes to these terms
We may update these terms. The version in force when you place an order applies to that order. The date at the top of this page shows the latest update.
